This Legal Notice governs your access to and use of the website imaginethatllc.store (the "Site") and your purchase of products from Imagine That LLC ("Imagine That," "we," "us," or "our"). By using the Site or placing an order, you agree to the terms below. If you do not agree, please do not use the Site or purchase from us.
1. Who We Are

2. Custom & Made-to-Order Products
Our products are custom-made and personalized to your order from images you supply. Because each item is produced specifically for you and cannot be resold:
- All sales are final. Personalized and made-to-order goods are not eligible for return, exchange, or refund except as required by law or as expressly stated in our Refund Policy.
- Orders enter production quickly. You may request a cancellation or change, but once production of your item has begun we cannot guarantee that the request can be honored.
- Defects and errors on our part. If your item arrives damaged, defective, or materially different from what you ordered due to our error, contact us within 14 days of delivery with photos of the issue and we will repair, replace, or refund it at our discretion.

3. Images You Submit — Rights, Warranties, and Acceptable Use
Our products are made from photographs and images you upload or otherwise provide ("Customer Content"). This is the most important section of this notice. By submitting Customer Content, you represent, warrant, and agree to all of the following:
(a) You own or control the rights. You are the owner of the Customer Content, or you have obtained all rights, licenses, consents, and permissions necessary to use it and to authorize us to reproduce it in physical form. This includes the consent of any identifiable person shown in the image and any rights held by a photographer, studio, or other creator.
(b) Limited license to us. You grant Imagine That LLC a non-exclusive, royalty-free license to use, reproduce, adapt, and process the Customer Content solely for the purpose of producing, fulfilling, and supporting your order. We do not claim ownership of your Customer Content, and we do not use it for marketing or any other purpose without your separate, explicit permission.
(c) Prohibited content. You may not submit any image that:
- infringes the copyright, trademark, publicity, privacy, or other rights of any person or entity;
- is unlawful, defamatory, harassing, hateful, or obscene;
- sexualizes or exploits any minor in any way;
- depicts another person without their consent; or
- you do not have the clear right to reproduce.
(d) Our right to refuse. We may decline, cancel, or refuse to produce any order, and may remove any Customer Content, if we believe in good faith that it violates this section or any applicable law. Where an order is cancelled for this reason before production, we will refund amounts paid for the cancelled item.
(e) Indemnification. You agree to defend, indemnify, and hold harmless Imagine That LLC and its members, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to Customer Content you submit, including any claim that it infringes the rights of a third party.
4. Product Appearance & Variation
Our products are handmade-to-order using 3D printing and photographic relief ("lithophane") techniques. As a result:
- Each piece is unique, and minor variations in tone, translucency, layer texture, and finish are inherent to the process and are not defects.
- The appearance of a lithophane depends heavily on the lighting behind or around it. Product photos on the Site are illustrative.
- Colors shown on your screen may differ from the finished product due to differences in monitors, lighting, and materials.
By ordering, you acknowledge and accept these characteristics.
5. Pricing, Payment & Availability
All prices are listed in U.S. dollars and are subject to change without notice. We make reasonable efforts to display accurate pricing and product information, but errors may occur. If we discover an error in the price or description of an item you have ordered, we may cancel the order and refund any amount charged. Payment is processed by our third-party payment providers; we do not store full payment card details.
6. Shipping & Risk of Loss
Shipping timelines, methods, and costs are described in our Shipping Policy. Production time is in addition to transit time. Risk of loss and title for purchased items pass to you upon our delivery of the item to the carrier. We are not responsible for carrier delays once an item has shipped.
7. Our Intellectual Property
The Site and its original content — including text, graphics, logos, product designs, photographs, and the "Imagine That" name and branding — are owned by Imagine That LLC and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. Nothing in this notice transfers any of our intellectual property to you.
8. Disclaimer of Warranties
Except as expressly stated in this notice or required by applicable law, the Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
9. Limitation of Liability
To the fullest extent permitted by law, Imagine That LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Site or any product. Our total aggregate liability for any claim arising out of or related to an order will not exceed the amount you actually paid for the product giving rise to the claim. Nothing in this section limits liability that cannot be limited under applicable law.
10. Privacy
Our handling of personal information, including images you submit, is described in our Privacy Policy. Please review it to understand how we collect and use your data.
11. Governing Law & Disputes
This Legal Notice and any dispute arising out of or relating to it, the Site, or any product is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. You agree that the state and federal courts located in Massachusetts will have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction and venue there.
12. Changes to This Notice
We may update this Legal Notice from time to time. The "Last updated" date at the top reflects the most recent version. Changes take effect when posted. Your continued use of the Site or placement of an order after changes are posted constitutes acceptance of the updated notice.
13. Severability & Entire Agreement
If any provision of this notice is found unenforceable, the remaining provisions will remain in full force and effect. This Legal Notice, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitutes the entire agreement between you and Imagine That LLC regarding your use of the Site and purchases.
